Your Work Permit Expires and the Renewal Has Not Arrived

It is a common situation with a specific answer — and an automatic extension that many employers do not know exists.

You filed the renewal on time. The expiration date on your employment authorization document is approaching, nothing has arrived, and your employer is asking questions. This happens constantly, and there is a mechanism for it.

The automatic extension

Certain applicants who file a renewal Form I-765 before the current document expires, in the same eligibility category, receive an automatic extension of their work authorization while the renewal is pending. The extension is not something you apply for separately — it flows from filing on time in a qualifying category.

The length of that automatic extension has changed several times in recent years, moving between different periods through temporary rules. Do not rely on a figure you read somewhere without a date on it. Verify the current period on uscis.gov for your specific category before making decisions based on it.

What you show your employer

For employment verification purposes, the combination of an expired EAD and the Form I-797C receipt notice for the timely-filed renewal generally serves as evidence of continued authorization during the automatic extension period. The receipt notice must show the same eligibility category.

Employers are frequently unaware of this rule and may move to terminate. A short written explanation citing the receipt notice usually resolves it. If your employer refuses to accept valid documentation, that is a problem worth getting advice on rather than accepting.

Not everyone qualifies

The automatic extension does not cover every category, and it does not apply if the renewal was filed after expiration or in a different category than the original. Applicants whose underlying status has lapsed are in a different situation entirely.

Practical steps

  • File renewals as early as the rules for your category allow. Do not wait for the final months.
  • Keep the receipt notice with your expired card, not filed away at home.
  • Create a USCIS online account and check case status directly rather than waiting on mail.
  • Update your address with USCIS immediately if you move — a card sent to an old address is a months-long problem.

If your permit has already expired without a timely renewal on file, stop and get advice before working. The consequences of unauthorized employment reach beyond the job.
